1. WHO ARE 3113 SURFERS PARADISE?


3113 Surfers Paradise (“3113”) is the trading name of Laudet Pty Ltd. which has agreements with the Body Corporate as the exclusive on site Letting and Sales Agent and the exclusive on site Caretaker of the 6 Orchid Avenue and 3113 Surfers Paradise Boulevard complex.

The majority of owners of the Hilton Residences have signed a Form 6 letting agreement with 3113 to have their apartments managed by 3113 who, in turn, has appointed Hilton to operate this short term letting business.




2. WHAT ARE THE DEDUCTIBLE EXPENSES FOR LETTING SERVICES BY 3113 SURFERS PARADISE?


Deductible Expenses means all and any of the following in respect of the Lot which shall be used each calendar month to calculate and determine the Return:

(a) the Letting Fee; 13.2% inclusive of GST
(b) the Other Services Fee; 17.6% inclusive of GST
(c) the Cleaning Costs; per night Lot is occupied (plus GST)
(d) the Laundry and Linen Fee; per night Lot is occupied (plus GST)
(e) Maintenance Fund Contribution; 3% of the Clients Share of Aggregated Receipts

The Other Services Fee means the fees or expenses payable by the Client to the Agent in respect of managing the Lot including the following:

(a) the costs of replenishment of toiletries, bath soap, stationery, toilet paper, tissues, tea and coffee and complimentary items supplied according to the Operator’s requirements, paper products, menus and other consumable items;
(b) standard periodic pest control treatments;
(c) bank charges, credit card charges and federal and state duties levied upon bank transactions applicable to the business of letting the Lot;
(d) the expenses of auditing the books, records and accounts of the Agent;
(e) all insurance premiums and excesses in respect of the insurances which the Agent is obliged to effect pursuant to this Agreement;
(f) staffing the front desk and reception (excluding letting services such as rent collection, check-in and check-out of Guests);
(g) porterage labour costs;
(h) advertising and promotion of the Lot and the Complex generally as quality guest accommodation; and
(i) arranging and supervising repairs and replacements to the Lot (except where they are connected with a Refurbishment or as part of the Annual Maintenance)




3. ARE APARTMENT REVENUES POOLED?


Yes, the Pooled Income Scheme (Aggregated Income) commenced on July 1, 2013. The Return to which the Client is entitled for the duration of the Agreement shall be calculated as follows:

R= (AR – AE) x UE x LDF ÷ AUE

R = The Return, being the calendar monthly return payable for the month in respect of which the return has been calculated.

AR = Aggregated Receipts received for the relevant month.
AE = Aggregated Expenses for the relevant month.
UE = The Lot Entitlement for the Lot.
AUE = The aggregate Lot Entitlement of all Participating Lots for the relevant month.
LDF = The Letting Day Factor for the relevant month.

There are 5 Lot Catergories: 1 Bedroom Residence, 2 Bedroom Deluxe, 2 Bedroom Deluxe Ocean, 2 Bedroom Deluxe Skyrise and 3 Bedroom Deluxe Ocean.




4. WHAT ARE THE CHARGES FOR CARETAKING SERVICES BY 3113 SURFERS PARADISE


3113 has been appointed by the Body Corporate to act as your on-site Caretaker, to manage the cleaning, repairs and maintenance of all Common Property.

The Body Corporate will pay 3113 for this service. To ensure Hilton Brand Standards are met, the majority of the Caretaking services will be performed by Hilton on behalf of 3113.

Hilton will also manage any repairs and maintenance requirements on behalf of 3113 for your apartment which may occur from time to time. The cost for any work will be deducted from your monies held in the Maintenance Fund.




5. HOW DO GUEST BOOKINGS OCCUR?


Hilton has 30 sales offices around the world. The Hilton Surfers Paradise Hotel and Residences is part of the Hilton global marketing and sales system. This includes extensive features such as agreements with airlines, credit card companies, booking agents, travel companies, and Hilton’s worldwide reservation system (on line and telephone). Hilton Surfers Paradise has a dedicated sales and marketing team and state of the art systems and software.

Bookings for Hilton Residences Surfers Paradise will be carried out by Hilton 24/7 on a worldwide basis. This includes promotions to their HHonors loyalty members, comprising some 25 million people worldwide.

Guests can directly book through the Hilton Surfers Paradise web page or telephone the property. Alternatively they book through Hilton’s worldwide reservations systems or through agents or travel businesses.

HHonors members have their own Hilton log in facility to make a booking.




6. HOW CAN I BOOK MY APARTMENT ?


All bookings are to be made by completing an owners request form on the Hilton page of this website. 3113 will inform Hilton of your booking request and subject to availability you will be issued a written confirmation. Owner’s bookings require 1 month’s notice during normal periods and 3 months notice during Peak Periods.

Peak Period means:
(a) 24 December to 21 January (inclusive) annually;
(b) Easter long weekend annually (Good Friday, Easter Saturday, Easter Sunday and Easter Monday);
(c) V8 SuperCar GC600 Race Week annually (Thursday to Sunday inclusive);

(d) Commonwealth Games from 4th April - 15th April 2018; and
(e) any other period reasonably determined by the Agent as being a period of peak occupancy rates for accommodation on the Gold Coast.

An owner can stay in their Residence free of any accommodation charges but will have to pay for any services provided including cleaning charges (weekly and at checkout) and any other services operated by Hilton (restaurant, bar, spa, additional cleaning etc).

7. DO I HAVE TO CONNECT ELECTRICITY TO MY APARTMENT?


Electricity and hot water services are provided by Metered Energy who will meter consumption of an individual apartment and whilst your apartment is in the Pooled Income Scheme, 3113 Surfers Paradise will process the account on your behalf as part of your deductible expenses.




8. DO I HAVE TO BUY A PHONE OR INTERNET SERVICE FOR MY APARTMENT?


All apartments are connected to the installed optic fibre network and your apartment will be supplied with phones by 3113 in accordance with Hilton’s Brand Standards.

Each apartment is connected to the Hilton operators for guest services. Outgoing calls are paid by the guest; as is the use of the extremely fast internet service.

The communication infrastructure also supports the television service and movie system for guests.

Guests will also be able to access the wireless internet system that has been installed throughout the complex.
